These terms and conditions apply to astrologers who sign up on Astro Kavach to provide online advice and professional consultations. When you sign in as an astrologer, you are contracting directly with Shiv Shakti Astro Services LLP. These Terms and Conditions of Use (Terms and Conditions) are a product of Astro Kavach, in whole or in part, of Astro Kavach, the Company Shiv Shakti Astro Services LLP (hereinafter referred to as "Astro Kavach", "we", "our", "Company") and is bound in connection with the use of the Astro Kavach Website i.e. https://www.astrokavach.com/ (referred to as the "Website") and the Services, Offered through the website or application.
Astro Kavach reserves the absolute right to change, add, modify or delete parts of these Terms and Conditions at any time at its sole discretion. It is the responsibility of astrologers to check our terms and conditions from time to time. If you continue to use the services of this website and the Astro Kavach application even after the Terms and Conditions are updated, it means that you agree to these changes.
By using this website and application, you agree to the Terms of Use below. If you do not agree, do not use this website or any of its services.
A. These Terms include the current Terms and Conditions as well as the Privacy Policy. These two jointly describe the exact legal terms between you and Astro Kavach.
B. After signing up on Astro Kavach, the conditions below will apply to you:-
A. You need to be cordial with Astro Kavach customers. Any kind of abusive behavior will not be considered, including foul language, threats, etc., and may deactivate your profile on Astro Kavach for at least 1 week. This period can be extended further. In order to resume the Services, you must give a written assurance not to repeat the same violation.
B. You agree to behave decently and to answer all kinds of questions patiently and calmly by the Client. You are forbidden to make public the personal information of your customers that you have received through Astro Kavach. In any case, you should not disclose the reason why the client asked you for advice. If found to be in violation of this clause, your profile will be deactivated with immediate effect without prior warning.
C. You agree to maintain the dignity of the Astro Astro Kavach. You are allowed to upload any type of content that does not comply with the law, is harmful, may defame someone, is filthy or obscene, violates anyone's privacy, may be used to harass or threaten someone, may invoke hatred, Astro is racially or ethnically unfair on or through Kavach. Posting, uploading, broadcasting, or making available this type of content in any way is prohibited on Astro Kavach.
D. You are prohibited from engaging in any act that could discredit the Astro Kavach or harm its interests. You should not post any derogatory comments or reviews about Astro Kavach on any social media platforms. You are prohibited from sharing the company's policies with anyone else or making negative comments about employees, officers, directors, agents, consultants, or those who are affiliated with Astro Kavach. It is agreed between the parties that you will not induce, persuade or encourage any of your acquaintances, clients or family members to do so. If found to be in violation of this section, your profile will be deactivated.
E. By signing up on Astro Kavach, you agree to graciously respond to all kinds of reviews or comments posted by the customer targeting you. You are forbidden to make public the personal information of your customers that you have received through Astro Kavach. In any case, you should not disclose the reason why the Client asked you for advice or why you disclosed any other confidential data of the Client that was disclosed to you during the consultation.
A. You agree not to disclose any personal information about yourself, related to your acquaintances, family, friends or anyone else, regardless of whether they are associated with you or not. This personal information may include, but is not limited to, personal contact numbers, bank account details, e-mails, websites, blog posts, social media profiles (Facebook, Instagram, WeChat, WhatsApp, Telegram, etc.). You are prohibited from sharing personal data with customers who are consulting you. If found to be in violation of this section, your profile will be permanently deactivated.
B. You agree not to demand any funds for the free service provided by you in any case.
C. You are not allowed to demand customers to deposit money into your personal account for the services offered through Astro Kavach.
D. You agree not to misuse any customer information or share your personal data directly or indirectly with the Customer. If found to be in violation of this section, your profile will be permanently deactivated.
E. Your account will only be activated if the compliance team finds you clean after checking your interactions with customers (which includes chats, texts, and phone conversations), otherwise your profile on Astro Kavach will be permanently deactivated.
A. You agree that you will not obtain the contact information of any clients who consult with you and will influence them to consult with you personally for their own personal benefit.
B. You only need to ask Astro Kavach's customers for your advice to ask any questions on Astro Kavach's portal. You must notify them to avoid sharing any personal information on a phone call/chat consultation.
C. If in any case, you are obliged to refer the customer to any other astrologer present on Astro Kavach, you only need to share the Astro Kavach ID and name of that astrologer. You should not share any other information about that astrologer. This personal information includes, but is not limited to, contact numbers, email addresses, personal websites, social media profiles (Facebook, Instagram, etc.).
D. You agree not to use any customer information shared with you during the consultation or contact through Astro Kavach. This personal information includes the contact number and you declare that you will not use it to contact the customer directly without Astro Kavach information for your personal benefit. If found to be in violation of this section, your profile will be deactivated.
A. In any case, Astro does not support or promote superstitious activities such as Kavach mechanisms, black magic, sorcery, vashikaran etc. During the consultation with astrologers, clients need to provide only practical and simple remedies. Any advice that is related to endangering the life of any human being or animal or causing any harm will be considered a gross violation by the astrologer.
B. You are prohibited from defaming or disrespecting any other astrologer listed on Astro Kavach while providing your services to any customer on Astro Kavach. You agree that one should not insult another astrologer by making negative comments on them as if they are incompetent, incompetent, less skilled, etc. Such a violation will be considered very serious and temporary inaction may apply to you.
A. You agree and declare that you will not share the Astro Kavach credentials provided to you with anyone. Astro Kavach system receives data through your IP address. If found to be in violation of this section, your profile will be deactivated.
B. You agree and declare that the details of the personal account made on Astro Kavach will not be shared with anyone. You should not deceive your client by providing counseling through someone else. If found to be in violation of this section, your profile will be deactivated and criminal liability will be imposed thereafter.
C. You are prohibited from misrepresenting or misrepresenting or misrepresenting your affiliation with any person or entity on Astro Kavach or any institution, guide, or other portal.
D. If found to be in violation of the above clauses, your profile will be deactivated. In addition, the green badge on your profile will also be removed.
A. In any case, Astro Kavach does not support providing predictions on sensitive topics that may induce inadvertent choices being made by the user/customer. You are prohibited from advising users about the following topic or any other situation that may influence the Customer to commit an offence.
You are forbidden to predict:-
If found to be in violation of this clause, the permanent profile will be inactive. It has been agreed between the parties that your profile will be black-listed and that you will not be able to contract with Astro Kavach in any way in the future.
B. You agree that if there are internet problems, incorrect predictions being made, technical glitches, or the customer is not satisfied with the service provided, you must voluntarily refund the amount to the customer and notify it to Astro Kavach. If found to be in violation of this clause, Astro Kavach reserves the right to refund the customer.
C. It has been agreed between the parties that all your chats and call conversations with customers will be duly recorded for quality reasons. At Astro Kavach may choose to monitor such preservation without informing you of the monitoring reasons.
D. You agree that you will only provide genuine answers to customers and will not copy and paste data from other websites and apps. You have to analyze customer issues and charts in depth and then write and type all the answers yourself. If we find that your answers have been copy-pasted or we receive any complaints of poor report quality, a refund will be processed to the customer immediately, as well as the removal of the green badge from it.
To get a verified green badge, you need to be available on the website for at least 100 hours each month. The green badge may be removed if you are found to be violating any of the terms and conditions mentioned in the Terms of Use.
Customers can provide reviews for the services you provide. These reviews can be positive or negative depending on the service you provide. You cannot force the user to provide a good review/rating for your services. You are prohibited from deleting or deleting any reviews submitted by a customer. If for any real reason, you want to make changes to the reviews, the admin needs to submit a request and appropriate action will be taken if necessary.
A. You agree that Astro Kavach has the sole and absolute right to control price changes, which may be modified at our discretion without prior notice.
B. In accordance with our payment terms, you agree and declare that of the amount paid by the Customer for providing its services through Astro Kavach, 60 percent will be acquired by Astro Kavach and 40 percent will be credited to your bank account provided by you, which will be purchased by you, Promotional plans will be subject to any kind of offer including discounts. Submitted to the user. Notwithstanding anything mentioned above, the amount to be paid to you for the sessions where the Client booked a consultation to apply the Promotional Offer shall be proportionate to the offer made by Astro Kavach in 40 percent or less of the amount deducted due to the promotional offer made to the Client.
C. You agree and acknowledge that you will be paid between the 1st and the 10th of every month i.e. in the second week of every month.
You agree and acknowledge that your profile may not be changed after it has been verified by the compliance team on Astro Kavach until the changes you proposed have been verified. To request any changes to the content or description of your profile, you will need to pick up the ticket from Astro Kavach dashboard.
The features and functionalities provided to you on Astro Kavach can be changed or removed at any time. Once the feature is updated or a new feature is added, you will be notified of it on the dashboard of the Astro Kavach application. Your continued use of the app and website will represent your acceptance of updates.
A. You acknowledge that any service you receive through Astro Kavach is chargeable. It is agreed between the parties that if a user wants a refund for the amount paid for your services, the complaint will be reviewed by the administrator/compliance team. If found genuine, a partial or full refund will be processed without your approval. You agree that the decision of the Astro Kavach in that case will be considered final. Once the refund is made, both parties will have the same for this terms i.e. you and the Astro Kavach.
B. If any genuine complaint is raised from foreign users, they will be liable to get back the amount paid at the payment gateway. You agree that if a refund is processed for a foreign user, it will also be refunded from your account.
C. Notwithstanding anything contained in the above clauses, users will be eligible for a refund for services delivered in the last 5 days from the date of the refund request being made by the customer.
A. You hereby undertake to indemnify, defend and hold Astro Kavach, its affiliates and its employees, directors, officers, representatives, consultants and agents (collectively referred to as the "Indemnification Party"), harmless from damages, lawsuits, damages, expenses, judgments and costs (including reasonable attorney fees and litigation costs) that arise in connection with or in connection therewith.
B. The indemnified party, before bringing any claim for indemnity, shall notify the other party to the proceeding, and shall reasonably deliver all legal arguments and other documents to defend the indemnified proceeding.
C. If the indemnifying party fails to notify the indemnifying party of the legal proceedings, the other party shall be relieved of its indemnity obligations to the extent that it was prejudiced by the failure of the indemnifying party.
This clause shall survive the termination or termination of this Agreement.
A. The above-mentioned rules and disputes that have arisen from them shall be governed by Indian laws.
B. The exclusive jurisdiction to consider and determine any dispute arising between U and Astro Kavach shall be decided in the courts located in Rajasthan, India.
A. Disputes arose in these terms and the website will be resolved in the first instance through methods such as mediation, mediation and conciliation.
B. The arbitrator's decision will be considered final and binding on you and the Astro Kavach at any time.
A. It is agreed between the two parties that if, according to a court of competent jurisdiction, any clause of these Terms and Conditions is held to be invalid, invalid or unenforceable, the remaining provisions shall remain in force in effect and in full.
B. Such provision being declared invalid, enforceable or invalid or determined shall be deleted from these Terms and shall not have any adverse effect on other clauses.
A. You agree that you will not disclose the confidential information of Astro Kavach to any third party and will hold it in strict confidence. You are prohibited from using confidential information other than the use of the Website, notwithstanding anything set forth in these Terms. You agree that you will not use Astro Kavach confidential information for any personal or third party benefit.
Astro Kavach will be the sole owner of all content generated and displayed on Astro Kavach's website, apps, and other platforms, including copies exchanged between customers and astrologers. It retains all proprietary rights. This clause shall survive the termination or termination of this Agreement.
A. You rightly agree and understand that Astro Kavach, its affiliates, and any of the above officers, directors, subcontractors, agents, and employees shall not be liable to any third party for any incidental, indirect, special, consequential, punitive, or projected damages, including loss, profit, revenue, data, usage, or other economic benefits of the business.
B. You understand that neither party shall be liable for breach of contract damages that are remote or speculative in nature or that the breaching party does not have foreknowledge or admission to these Terms because of the actual cause.
C. It is agreed between the parties that neither party can assign these Terms or any of its rights or obligations without the prior consent of the other.
